Who we are

CarPresto is a vehicle buying service operated by VIP Automotive Group (VIP Auto Group). "We", "us" and "our" mean VIP Automotive Group and the VIP Auto Group dealerships that appraise and buy vehicles through CarPresto.

Who can use the Service

You must be at least 18 years old and able to enter a binding contract. You may use the Service only for a vehicle you own or are authorized to sell.

Estimates are not offers

An estimate shown on this site, in an email or in your portal, including its good-through date, is built from market data and the details you provide. It is not an offer to buy your vehicle, and we are not bound by it.

Estimates rely on third-party data and on your answers. We do not promise that an estimate is accurate, complete or current, and you should not rely on it to make financial decisions. An estimate ends on its good-through date.

A firm offer exists only when a dealership issues one in writing at an in-person appraisal, with an amount, an expiration date and time, and the purchasing dealership named. Firm offers are governed by the Offer Terms, the Title Policy and the purchase documents you sign. If these terms conflict with documents you sign, the signed documents control.

Our right to decline

We may decline to make an offer, or to buy any vehicle, for any lawful reason, including vehicles outside our program, vehicles we cannot verify and vehicles we do not need for inventory.

Accurate information

You agree that the vehicle, ownership and contact details you give us are accurate, current and complete. If they are not, any estimate or offer may be revised or withdrawn, and the remedies in the Offer Terms apply to a completed sale.

Communications and electronic records

By giving us your email address or phone number you agree that we may contact you about your vehicle, your estimate, your appraisal and your sale. Texts are sent only if you consented to them, and you can stop them at any time by replying STOP. You can stop marketing email with the link in any email; messages about an active appraisal or sale may still be sent.

You agree to receive agreements, disclosures and notices electronically, and that your electronic signature and acceptance have the same effect as a handwritten signature.

Acceptable use

Do not submit false information, use a vehicle or identity that is not yours, or impersonate anyone.

Do not use bots, scripts or other automated means to request estimates, collect data or get around security and bot checks, and do not copy, scrape, resell or use estimates or other content from the Service for any commercial purpose, including pricing vehicles for resale or building a competing service.

Do not interfere with, probe or reverse engineer the Service. We may limit, suspend or block access for anyone who breaks these rules, without notice.

Our content

The Service and its content, data, design, software and trademarks belong to VIP Automotive Group or its licensors. We give you a limited, personal, revocable, non-transferable right to use the Service to sell your own vehicle. Franchise brand names appear only to identify the dealerships and vehicles they sell.

Links to maps, dealership websites and other services are for convenience. We do not control those services and are not responsible for their content or practices.

Disclaimers

THE SERVICE AND ALL ESTIMATES ARE PROVIDED AS IS AND AS AVAILABLE. TO THE FULLEST EXTENT ALLOWED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WE DO NOT PROMISE THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE.

Limitation of liability

TO THE FULLEST EXTENT ALLOWED BY LAW, WE AND OUR DEALERSHIPS, OFFICERS, EMPLOYEES AND SERVICE PROVIDERS ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST SAVINGS OR ANY DIFFERENCE BETWEEN AN ESTIMATE AND AN OFFER OR SALE PRICE. OUR TOTAL LIABILITY FOR ANY CLAIM ABOUT THE SERVICE IS LIMITED TO $100.

This section does not limit liability that the law does not allow to be limited, or our obligations under purchase documents you sign.

Indemnity

You agree to defend and hold us harmless from claims, losses and costs, including reasonable attorney fees, that arise from information you gave us that was false, from your misuse of the Service or from your breach of these terms.

Governing law and courts

New York law governs these terms, without regard to conflict of law rules. Any claim about the Service will be brought only in the state or federal courts located in Nassau County, New York, and you and we consent to their jurisdiction.

Changes to the Service and these terms

We may change or stop any part of the Service and may update these terms at any time. Updates take effect when posted with a new date above. Continuing to use the Service means you accept them. An update does not change a firm offer already issued.

Changing your mind

You may stop at any point before you sign purchase paperwork, with no penalty and no fee.

General

If any part of these terms is found unenforceable, the rest stays in effect. Our not enforcing a term is not a waiver. You may not transfer your rights under these terms; we may transfer ours. These terms, with the Privacy Policy, Offer Terms, Title Policy and Cookies Policy, are the whole agreement about the Service.
